Terms of Sale
BETWEEN
The Company BRUSSELS KETJEP sprl, for its part, whose legal head office is Chaussée de Wavre 1731, 1160 Auderghem, registered with the Trade and Companies Registry of Brussels under number BE 0541 318 990; the company may be reached by email by clicking on the contact form, accessible via the « CONTACT » page on the website; hereinafter, the « Seller » or the « Company. »
AND
The physical or legal person that shall purchase products or services, as the other party, hereinafter, the « Buyer » or « Customer. »
It has been stipulated and agreed as follows:
PREAMBLE
The Seller is a the producer of products and services, BRUSSELS KETJEP, delivered exclusively to consumers, and marketed through its websites (e.g., http://www.brusselsketjep.com). The list and description of goods and services offered by the Company are available on the aforementioned web pages.
Article 1: Purpose
These Terms and Conditions specify the rights and obligations of the parties in the on-line sale of products offered by the Seller.
Article 2: General Provisions
These General Terms and Conditions (GTC) apply to all sales of products, made through the websites of the Company, which make up part of the Contract between the Buyer and Seller. The Seller reserves the right to modify these General Terms and Conditions at any time by publishing a new version on its website. The applicable Terms are therefore those in effect on the date of payment of the order. These Terms are available on the website of BRUSSELS KETJEP at the following address: www.brusselsketjep.com/terms-of-sale. BRUSSELS KETJEP also ensures that their acceptance is clear and unqualified by providing a check-box to be ticked. The Customer declares he is aware of all these Terms and Conditions, and where applicable the Special Conditions of Sale relating to a product or service, and accepts them without restriction or reservation. The Customer also acknowledges that he has received the necessary information and advice to ensure the adequacy of the offer to meet its needs. The Customer states he is able to lawfully contract under Belgian Law or is validly able to represent the person or entity undertaking the transaction. Unless otherwise stipulated, the information as recorded by BRUSSELS KETJEP constitutes proof for all transactions.
Article 3: Pricing
Prices for products sold through Internet sites are indicated in euros including all applicable taxes (VAT + other taxes) and is precisely described on the Product description pages. They are also indicated. in euros inclusively of all applicable taxes (VAT + other taxes), on the product order page, and exclude the specific shipping costs. For all products shipped outside the European Union, the price is calculated by automatically excluding taxes on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These duties are not within the charge of the Seller. They will be borne by the buyer and he is responsible for them (including statements, payment to the competent authorities, etc.). The Seller invites the buyer in this respect to become fully informed of said matters with the relevant local authorities. BRUSSELS KETJEP reserves the right to change prices at any time in the future. In this event, the rates charged are those in effect during the validation of the order. The telecommunications costs required for access to the Internet sites of BRUSSELS KETJEP are to be borne by the Customer, along with, where necessary, the cost of delivery.
Article 4: Conclusion of the Online Contract
The Customer must follow a series of steps specific to each product offered by the Seller in order to complete his order. However, the steps outlined below are systematically implemented: ➢ Information on essential characteristics of the product; ➢ Product Selection, where applicable, of the Customer’s choices, and entry of the essential data of the Customer (identification, address …); ➢ Acceptance of these Conditions of Sale. ➢ Verification of the items of the order and, if necessary, correction of errors. ➢ Following instructions for payment, and then the payment of the products ordered. ➢ Delivery of goods. The Customer will receive email confirmation upon payment of the order, as well as an acknowledgment confirming receipt of the order. For products to be delivered, the delivery will be made to the address specified by the Client. For the purposes of proper implementation of the order, the Customer undertakes to provide accurate self-identification. The Seller reserves the right to refuse the order, for example for any unusual demand, those made in bad faith, or for any other legitimate reason. BRUSSELS KETJEP also reserves the right to refuse any order from a customer with whom there is a dispute, whether past or present. In this case, the Company will notify the Customer by email.
Article 5: Products and Services
The essential characteristics of the goods and services, and their respective prices are made available to the buyer on the web pages of BRUSSELS KETJEP. The customer confirms having received a detailed schedule of delivery costs and the terms of payment, delivery and execution of the contract. The Seller agrees to fulfil the customer’s order within the limits of available stocks of products only. Otherwise, the Seller shall inform the Customer. In accordance with Belgian law, these are subject to a summary and a confirmation upon confirmation of the order. The parties agree that the illustrations or photographs of the products offered for sale are not contractual. Except in special circumstances, the rights granted hereunder are only to the physical person signing the order (or the holder of the release email address). In accordance with the legal requirements for compliance and governing hidden defects, the Seller will refund or exchange defective products, or those not corresponding to the order. The refund can be requested as follows: the Customer shall contact BRUSSELS KETJEP by e-mail at the address by info@brusselsketjep.com to rep
ort problems with any item(s). The Client will take care to clearly identify, attach a photo, clearly putting forward the faulty aspects of the delivery, and to provide bank details for a refund.
Article 6: Retention of Title Clause
The products remain the property BRUSSELS KETJEP until full payment.
Article 7: Delivery
The products shall be delivered to the shipping address specified when ordering, and the time indicated. This period of time does not take into account the order preparation time. The Seller recalls that when the Customer takes physical possession of the goods, the risk of loss or damage to the goods is transferred to therewith. The user may not request compensation in the event of late delivery. It is the Customer’s responsibility to notify the carrier of any reservations about the product delivered. In case of an incomplete address or wrong shipping address provided by the Customer, any new shipment will be charged in addition to the original order. In the case of free delivery, the new shipment will be charged.
Delivery times are 48h for Belgium and within 3 to 6 days for Europe. Around the world, the deadlines vary depending on the Customer’s location. BRUSSELS KETJEP communicates the package number to the Buyer when the shipment confirmation is made. The latter can then track his package via the tracking link shown on the shipment statement.
If the package is dropped off at a relay point by the delivery provider and the package in question is not picked up by the Customer within the time limit set by the delivery provider, the Customer will have to pay for the new shipment. If the Customer has not received a notification concerning the deposit of his parcel in a relay point, neither by email, nor by postal message, he can then enter a complaint with the delivery service of his country to claim a refund of the shipping costs.
Brussels Ketjep will not be held responsible in the event of refusal to reimburse the shipping costs following the complaint, and shall in no case reimburse in place of the delivery service provider.

Article 8: Availability and Presentation
Orders will be processed within the limits of our available stocks and subject to availability from our suppliers. In case of unavailability of an item for a certain period, you will be immediately notified of predictable delivery times and the order of said article may be cancelled upon request. The Customer can then request a credit for the amount of the item or refund.
Article 9: Payment
Payment is due immediately with the order. The secure online payment by credit card is carried out by our PAYPAL payment provider. You can pay via PayPal, VISA, MasterCard, American Express or Discover Network. At the time of payment, the Customer will be offered only the option to pay through PayPal. During the « Checkout with PayPal » steps he can then choose to pay by PayPal if he already has an account, or to « Check out as Guest ». It is through the latter option that the Customer can then pay by VISA, MasterCard, American Express or Discover Network. Once payment is made by the Client, the transaction is debited immediately after verification of his information. By providing bank details on the sale, the Customer authorizes the Seller to charge his or her card for the amount relating to the stated price. The Client confirms that he is the legal owner of the card and is legally entitled to use it. In case of error, or failure to charge the card, the sale is immediately cancelled and the order automatically cancelled.
Article 10: Period of Retraction
« The consumer has a period of fourteen days to exercise his right of withdrawal from the contract without any reasons or payment of any penalties, except, where applicable, the cost of returns. » « The period mentioned in the preceding paragraph shall run from the receipt of the goods or acceptance of the offer for services. » The right of retraction may be exercised by contacting BRUSSELS KETJEP as follows: contact BRUSSELS KETJEP by e-mail at info@brusselsketjep.com and inform the Seller of your decision to exercise your right of revocation. BRUSSELS KETJEP will inform you by email of the procedures for returning your order at your expense, by printing your return label directly or by going to the point of closest post to you. In the event the right of retraction is exercised within the aforementioned period, only the price of the product purchased will be refunded, while the cost of return remains that of the Customer. Returns of products are to be made in their original condition and complete wrapping (packaging, accessories, manuals …) so they can be marketed as new. Regarding the reimbursement procedure, you will be asked to communicate by e-mail the account data where you want to be reimbursed, because, by working with a payment service provider for receiving payments, BRUSSELS KETJEP does not have access to customer bank data.
Article 11: Guarantees
According to the law, the Seller assumes two guarantees: compliance and hidden product defects. The Seller will reimburse the buyer or exchange any obviously defective products, or goods not corresponding to the order placed. Regarding requests for reimbursement, refer to Section 4: Products and Services.
Article 12: Claims
If necessary, the Buyer may make any claim by contacting the company through the following coordinates info@brusselsketjep.com.
Article 13: Intellectual Property Rights
The trademarks, domain names, products, software, images, videos, texts or generally any object of the intellectual property and related rights information are, and shall remain, the exclusive property of KETJEP BRUSSELS. No assignment of intellectual property rights is conducted through these Terms. Any reproduction, whether partial or total, or modification or use of such property for any reason, is strictly prohibited.
Article 14: Force majeure
The implementation of the obligations of the seller to the term hereof shall be suspended upon the occurrence of a chance event or force majeure that prevents its execution. The Seller will inform the Customer of the occurrence of such an event as soon as possible.
Article 15: Nullity and modification of the contract
If any provision of this contract was cancelled, this shall not result in the nullity of the other provisions that remain in force between the parties. Any contractual modification is valid only after a written agreement signed by the parties.
Article 16: Protection of personal data
According to the law, you have the right to question, access, modify, oppose and correct your personal data. By adhering to these Terms and Conditions, you agree that we may collect and use this data for the purpose of the fulfilment of this contract. By entering your email address on one of the sites in our network, you will receive emails containing information and promotional offers on products published by BRUSSELS KETJEP. You can unsubscribe at any time. You simply have to click on the link at the end of our emails. We track attendance on all of our sites. For this, we use tools such as Google Analytics.
Article 17: Applicable law
All clauses in these general conditions of sale, and all purchases and sales contemplated therein, will be subject to Belgian law.
